Possible Amendments to Minnesota Rules Chapter 4620, Enclosed Sports Arena
Subject of Rules. The Minnesota Department of Health requests comments on possible amendments to Minnesota Rules, Chapter 4620, Minnesota Enclosed Sports Arena rules. The Department's primary objectives for the rule revision are:
- Clarifying air monitoring and documentation requirements
- Ensuring that air-quality standards are consistent with current health-risk data
- Separating the rule into distinct sections for indoor ice arenas and indoor motorsports applications
- Prescribing more specific requirements for indoor motorsports applications
- Allowing for the use of modern air-monitoring technology
Statutory Authority. Minnesota Statutes, Chapter 144.1222 authorizes the Department of Health to adopt rules relating to indoor air quality in the operation and maintenance of enclosed sports arenas.
Public Comment. Interested persons or groups may submit comments or information on these possible rule amendments in writing until further notice is published in the State Register that the Departments intends to adopt or to withdraw the rules. The Department will not publish a notice of intent to adopt the rules until more than 60 days have elapsed from the date of this request for comments.
The Department plans to appoint an advisory committee to comment on the possible rules. The advisory committee will consist of representatives of the likely affected parties and some topical experts. The committee will meet approximately four times over four to six months to discuss proposed revisions to the rules.

NOTE: Comments received in response to this notice will not be included in the formal rulemaking record submitted to the administrative law judge if and when a proceeding to adopt rules is started. The agency is required to submit to the judge only those written comments received in response to the rules after they are proposed. If you submitted comments during the development of the rules and you want to ensure that the Administrative Law Judge reviews the comments, you should resubmit the comments after the rules are formally proposed.
