Rule Development

Public Stakeholder Meeting to inform rule development Summer 2012 August 28, 2012 MDH held a public meeting on August 28, 2012 to solicit input. Please see 2012/2013 Amendment - Public Meeting for more information.
A draft of the proposed amendments to HRL rules and Statement of Need and Reasonableness (SONAR) Winter 2013 March 4, 2013 The draft SONAR and proposed rules amendments were added to the MDH website.
Notice of Intent to Adopt – Dual Notice Early 2013 March 11, 2013 - April 10, 2013 MDH published a "Dual Notice of Intent to Adopt Rules" in the State Register.
Office of Administrative Hearing (OAH) Review
Office of Administrative Hearings (OAH) Review Early to Mid 2013   An Administrative Law Judge (ALJ) will review the proposed rules and related documents to ensure agencies have the statutory authority to propose or amend rules, demonstrate the rule’s need and reasonableness, give adequate notice regarding the rules, and comply with other rulemaking requirements.
Governor’s Office Approval
Governor's Office Approval Early to Mid 2013   Upon the ALJ's review and approval, the Governor will review the proposed rules.
Adoption of Rules
Adoption of Rules Mid 2013   Upon the Governor’s approval of rules, MDH will publish Notice of Adoption in the State Register.

Note:  A typical timeframe for rulemaking from publishing the Notice of Intent to Adopt Rules until the date the rules become effective is about three months if there is no hearing and about five months if there is a hearing.
