Title Protection: Restriction on Use; Regulatory Functions

This page contains information for Housing with Services, and Home Care Providers concerning the use of the term "Assisted Living". The 2006 Minnesota Legislature passed legislation that defines who can use the term "Assisted Living" and criteria that must be met in order to use the term. The legislation is effective January 1, 2007.

Assisted Living means a service or package of services advertised, marketed, or otherwise described, offered, or promoted using the phrase "Assisted Living" either alone or in combination with other words, whether orally or in writing, and meets the requirements of Minnesota Statute 144G.

News and Announcements

Housing with Services (HWS) establishments that represent themselves or their services as assisted living were required to complete an online version of the Consumer Information Guide as part of the annual HWS registration process this past summer. If establishments modify the services that they provide they will need to update the online guide in addition to revising the printed version to distribute to prospective clients. Establishments can access the online version of the Uniform Consumer Information Guide at the same web address as was used to renew the HWS registration which is https://pqc.health.state.mn.us/icsd/index.jsp.

The user name and password used for registration is required to access this web site to modify the Uniform Consumer Information Guide. If you have lost your password, please call Sue Joyce at 651-201-4109 or e-mail her at suzanne.joyce@state.mn.us.

Assisted Living Uniform Consumer Information Guide (MSWord/ 7 Pages) and Instructions for Completing the Guide (pdf:28kb: 4 pages) – Assisted Living providers are required to provide prospective and current clients with a copy of the Uniform Consumer Information Guide.

The above links are to the guide in the approved format that assisted living providers must use and instructions for completing the guide. The guide is provided in MS Word format. The document may be completed electronically, printed and saved by the assisted living provider for future reference.

Housing With Services Registration - Housing With Services that plan to use the phrase "Assisted Living" in their representation to the public are required to submit a verification form along with their initial registration or annual renewal.

Minnesota Home Care Bill of Rights for Assisted Living Clients - The Assisted Living legislation specified a revised version of the Home Care Bill of Rights to be provided to assisted living clients that met the definition in MN Statute 144G. A version of the Combined (State and Federal) Home Care Bill of Rights to be used with Assisted Living Clients is also available.

Arranged Home Care Provider - To meet the minimum requirements to be called "assisted living" the Housing With Services (HWS) must provide or have an arrangement with either a licensed Class A Professional Home Care Agency and/or a licensed Class F Home Care Agency (previously called an Assisted Living Home Care Provider) to provide health related services.

Review Results - The Assisted Living Check list completed during the review are posted after the form has been reviewed by a supervisor and mailed back to the Housing with Services establishment.

A Guide to MN Statute 144G Assisted Living Review Process - A Guide to the Survey Process for Assisted Living includes the MN Statute 144G Assisted Living Checklist. The checklist will be posted on the Minnesota Department of Health web site following a review of the assisted living.

Housing With Services Assisted Living Work Sheet - This is an optional worksheet that housing with services establishments may use to monitor compliance with assisted living minimum requirements and assist in communicating their compliance with Minnesota Statute 144G.  MSWord Version    PDF Version  (2 pages)
