Licensing, Administration, Waivers, And
Health Services Rules For Nursing Homes
On October 17, 1994, the Minnesota Department of Health published proposed rules relating to licensing, administration, waivers, and health services in licensed nursing homes in the State Register . Each nursing home was sent a copy of the proposed rules, and had an opportunity to comment on the proposed rules. A public hearing on the proposed rules was held November 21, 1994. Based on the written comments received and the testimony at the hearing, the Department amended portions of the proposed rules.
The Minnesota Department of Health has now adopted new licensing rules for licensing, administration, waivers, restraints, comprehensive resident assessments, comprehensive plans of care, clinical records, nursing services, medical directors, physician and dental services, infection control, and medications and pharmacy services in nursing homes. These new licensing rules are found in Minnesota Rules , parts 4658.0010 to 4658.0580 and 4658.0700 to 4658.1365. To conform with these new rules, technical revisions were made to Minnesota Rules , parts 4655.0090, 4655.9200, (4655.9300 Repealed), (4655.9324 Repealed), (4566.9326 to 4655.9329 Repealed), (4655.9331 Repealed), (4655.9332 Repealed), (4660.1700 Repealed), 4660.5030, 9050.0040, 9050.0210, 9050.1030, 9050.1070, and 9505.0390. The notice of adoption of these rules appears in the August 14, 1995 State Register .
These rules will become effective November 12, 1995.
Beginning November 12, 1995, nursing homes will no longer be required to comply with Minnesota Rules , parts 4655.0100 to 4655.4000, 4655.4200 to 4655.5100, 4655.5400 to 4655.6800, 4655.7600 to 4655.7790, and 4655.8100. (Chapter 4655 applies only to boarding care homes unless the content clearly indicates otherwise, per 4655.0090.)
Beginning November 12, 1995, nursing homes will be required to comply with Minnesota Rules , parts 4658.0010 to 4658.0580 and 4658.0700 to 4658.1365.
Boarding care homes are still required to comply with Chapter 4655. The new rules in parts 4658.0010 to 4658.0580 and 4658.0700 to 4658.1365 do not apply to boarding care homes.
