The rule relating to health care homes is now official.

The Minnesota Department of Health (MDH)and the Minnesota Department of Human Services (DHS) published the adopted rule related to health care homes on January 11, 2010. Minnesota Statutes §256B.0751, subd.2, directs MDH and DHS to develop and implement standards of certification for health care homes for state health care programs. This adopted rule carries out these directions by developing and implementing the standards. It also spells out the procedures for certification and re-certification of health care homes. The rule became effective when it was published.

MDH adopted the rule under expedited rulemaking authority, which allows for public input on the proposed rule during a 30-day public comment period. The comment period began on Monday, July 6, 2009, and ended at 4:30 p.m. on Thursday, August 6, 2009. MDH and DHS modified the proposed health care homes rules based on public feedback.

A health care homes memorandum was written and submitted to the Office of Administrative Hearings to explain how its rules were authorized by its enabling statute.
