Enforcement and Exception Provisions of Minnesota Statutes, Section 62J.536 During the Covid-19 Pandemic Response In response to the current Covid-19 pandemic emergency, Governor Walz signed Emergency Executive Order 20-32 (PDF) on April 8, 2020 authorizing the Commissioner of Health to temporarily delay, waive, or modify a number of provisions in law and applicable rules. Recently this authorization was extended to apply if necessary to the enforcement and exception provisions of Minnesota Statutes, section 62J.536, Subdivisions 2a and 2b and related rules. Use of the authorization may be necessary for example in the event that Minnesota Department of Health (MDH) staff responsible for administering MS §62J.536 have been reassigned to the Covid-19 response effort. At this time, the regular ongoing enforcement of Minnesota Statutes, section 62J.536 and related rules is continuing unchanged. If the authorization above to temporarily delay, waive, or modify the MS §62J.536 requirements is invoked, that information will be posted on the MDH Health Care Administrative Simplification webpage, and communicated through additional means.
