Health Risk Limits Rules for Groundwater 
Rules Amendments - Contaminants

August 2023

MDH proposes amendments to the Health Risk Limits (HRLs) Rules approximately every two years. This allows new and updated human health-based water guidance values to be considered for adoption into rule. The current regular rulemaking began in January 2021 and is under OAH review. 

In June 2023, the Minnesota Legislature passed a session law that requires Minnesota Department of Health to "...amend the health risk limit for perfluorooctane sulfonate (PFOS) in Minnesota Rules, part 4717.7860, subpart 15, so that the health risk limit does not exceed 0.015 parts per billion..."  (Laws of Minnesota, Chapter 60, Article 3, Section 34) This rulemaking will begin in August 2023 with an expected end date of 2026, per session law. 

The water guidance values for the contaminants listed below are under consideration for the Health Risk Limits Rules amendment process. The first list is for the current regular rulemaking and the second list is for the additional Session Law rulemaking. MDH is interested in comments on the proposed values for these contaminants.
