Change of Ownership and Trained Medication Aide Rulemaking

The Minnesota Department of Health is proposing a rulemaking project to update and make minor changes to Chapter 4658, Nursing Homes. Minnesota state agencies adopt and update state rules to help clarify and administer laws they enforce.

MDH proposes minor updates to the following rules:

  • Proposes minor updates to the change of ownership rules to reflect law changes made in 2022, as required by statute (Minnesota Rules, 4658.0010 to 4658.0055)
  • Proposing an update to the education requirements of Trained Medication Aides (TMA) to expand access to training opportunities. (Minnesota Rules, 4658.1360, Subp. 2(B))

Once a rule is adopted, it has the force and effect of law, so it is critical that those who are potentially affected by the rule change have a voice in the process. The rulemaking process offers several opportunities for affected parties and the public to offer comments or concerns on rules. Goals

This rulemaking process proposes to change the rules in Chapter 4658 to:

  • Eliminate references to nursing home license waivers that are no longer allowed under statute
  • Align with other changes to Minnesota Statutes (2022 Minnesota Laws, Chapter 98)
  • Align with current business practices and tools
  • Create a new framework to allow other educational institutions to offer a Trained Medication Aide program, while maintaining high educational standards.

  • July 24, 2023: Request for comments published in the State Register
  • Fall 2023: Drafting of rule language and Statement of Need and Reasonableness (SONAR)

  • To Be Determined: Adoption of Rules
